Photographers

Photographers generally retain copyrights in their photographs, subject to certain exceptions, such as fair use and work-for-hire.

Photographers should be aware of the rights of publicity of the subjects of their photographs. Most photographers should consider obtaining consent from individuals before publishing photographs with their image or likeness. Photographers should also consider whether to provide the subjects of their photographs with a license to reproduce the photographs. In some cases, the subject might wish to own the copyright in the photographs.
